    • I, Miss Agnes Murray Silver, residing at Marchbank, Bieldside, in the County of Aberdeen, for the event of my death and the setttlement of the succession of my means and estate, do hereby nominate and appoint James Davidson, Agent of the North of Scotland Bank, Limited, Cults, in the County of Aberdeen, and Doctor Robert Bruce, residing at Thorsby, Cults, aforesaid, and the survivor of them, to be my trustees and executors and trustee and executor with all the powers competent to said offices and necessary for the execution of these presents, including power of sale of my whole means and estate either by public roup* or private bargain
      and with or without previous advertisement in such lots and at such price as my trustees and executors or trustee and executor may think
      proper; And I do hereby dispone, assign, legate, bequeth, devise and make over to and in favour of the said James Davidson and Robert Bruce as trustees and executors foresaid and the survivor of them in trust for the ends, uses and purposes aftermentioned, and to their or his assignees, All and Sundry the whole means and estate heritable and moveable, real and personal of whatever denomination the same may be which shall be owing and belonging to me at the time of my death with the rents, interest, profits, produce, and writs, titles, vouchers, and securities thereof, and all relative action and executoion; But in trust always for the following purposes namely:- (FIRST) For payment of all my just and lawful debts, sick-bed and funeral charges and the expenses of execution hereof; (SECOND) I direct my trustees and executors (First) to deliver to the niece Annie Burgess Silver, residing at Otago Cottage, West Cults, in the County of Aberdeen, her Aunt Lizzie's paintings, and to my niece Mrs Agnes May Silver or Clemens, residing in Huntly, in said County, my bed and table linen and blankets, but should she die before me or before actually receiving delivery of such linen and blankests, the same shall be delivered to the said Annie Burgess Silver to choose such articles of household furniture belonging to me as she may desire to possess, the said Agnes May Silver or Clemens to be allowed to choose from the remaining articles such article or articles as she may desire to possess: But declaring that, should the latter died before me or before obtaining possession of the article or articles chosen by her such article or articles shall be delivered to the said Annie Burgess Silver. (THIRD) I direct my trustees and executors to pay to my said niece Annie Burgess Silver the sum of Two hundred and fifth pounds sterling free of legacy duty; And I declared that this legacy shall be paid in full, but without interest, should there be sufficient funds to do so and before any of the legacies hereinafter bequeathed shall be paid; (FOURTH) I direct my said trustees and executors to pay the following legacies, which shall all rank equally, namedly:- To my said niece the said Agnes May Silver or Clemens, the sum of Two hundred pounds sterling declaring that should she die before me or before she actually receives payment of the said sum my trustees and executors shall pay the said sum to my said niece Annie Burgess Silver; To my nephew and nieces Walter Terry, Mrs. Beth Terry or Prindiville and Audrey Terry, all now or sometime residing at Liveoak, California, United States of America, equally between them, share and share alike and the survivors and survivor of them, the lawful issue of any predeceasing child to receive the share which the parent would have received if in life, the sum of Three hundred pounds sterling; To Ulyssess Simpson Terry, father of the said Walter Terry, Mrs. Beth Terry or Prindiville and Audrey Terry, the sum of Fifty pound sterling; Declaring that in the event of him predeceasing me, or dying before actually receiving payment, the same shall be paid to his said children, equally between them, share and share alike, and the survivors and survivor of them, the lawful issue of any predeceaser to receive the share which the parent would have received if in life: And to Margaret McIntosh or Gibson, residing at Oak Cottage, Tilekiln Lane, Bexley, Kent, the sum of Twenty pounds sterling. And I declare that my trustees and executors and my estate shall not be liable to pay any interest on the said legacies:
      whole of my means and estate into cash, so far as they may not have already done so, and to divide the whole free residue of my estate amongst my said nephew and nieces Walter Terry, Mrs. Beth Terry or Prindiville and Audrey Terry, equally between them, share and share alike, and the survivors and survivor of the, the lawful issue of any predeceasing child to received the share which the parent would have received if in life. And I give the fullest powers competent by law to my trustees and executors and particularly, but without prjudice to said generality, power to appoint factors and/of law Agents who may be of their own number and to pay him or them the ordinary professional remuneration for his or their trouble or practice to the contrary notwithstanding. And I reserve my own liferent of the premises and pwoer to alter innovate, and/or revoke these presents in whole or in part at pleasure. And I revoke all testamentary writing made by me prrior to the date hereof. And I consent to registration for preservation IN WITNESS WHEREOF these presents typewritten on this and the preceding page are subscribed by me at Aberdeen on the Twenty fourth day of August Nineteen hundred and thirty three before these witnesses Mary Williamson Grant, Cashier, resident at Fifteen Braemar Place, and Ann Wishart Brown, Clerkess, residing at Twelve Holburn Road, both in Aberdeen.
