At Stonehaven the seventeenth day of June in the year One thousand eight hundred and ninety. In presence of John Guthrie Smith esquire Advocate Sheriff of Aberdeen, Kincardine and Banff. Compeared Alexander Morrison Williamson Advocate in Aberdeen as Procurator and gave in the Inventory of the Personal Estate of the deceased ADAM SILVER and Oath thereon underwritten desiring that the same might be inserted and registered in the Sheriff Court Books of Kincardineshire in the Sheriffdom of Aberdeen, Kincardine and Banff, along with a Last Will and Testament executed by the said deceased : Which desire the said Sheriff found reasonable and ordained the same to be done accordingly and of which page 647

In presence of George Anderson one of Her Majesty?s Justices of the Peace for the County of Aberdeen, appeared Peter Howie, grocer in Aberdeen, Executor of the deceased ADAM SILVER farmer residing at MILL OF MONQUICH aforesaid in the Parish of Fetteresso and County of Kincardine who being solemnly sworn and examined Depones that the said ADAM SILVER died at MILL OF MONQUICH aforesaid domiciled there on the twenty fifth day of April eighteen hundred and ninety and left a widow and lawful issue surviving. That the deponent has entered upon the possession and management of the deceased?s estate as executor nominated by him along with MRS CATHERINE ANDERSON or SILVER widow of the said deceased ADAM SILVER in a Last Will and Testament by him on the third day of April eighteen hundred and ninety which is now exhibited and signed by the deponent and the said George Anderson of this date as relative hereto: That the Deponent does not know of any Testamentary Settlement or writing relative to the disposal of the deceaseds?

? deceaseds personal Estate or Effects or any part thereof other than said Last Will and Testament: That the foregoing Inventory signed by the Deponent and the said George Anderson as relative hereto is a full and complete Inventory of the Personal Estate and Effects of the said deceased ADAM SILVER wheresoever situated and belonging or due to him beneficially at the time of his death in so far as the same has come to the Deponents knowledge: That the deponent does not know of any money or property belonging to the deceased secured by Scottish Bonds or other instruments excluding Executors: That the said deceased had no heritable estate in this Country in so far as known to the Deponent: That the said deceased ADAM SILVER was due and owing at the time of his death to persons resident in the United Kingdom the debts enumerated in the foregoing Schedule. That these debts are payable by law out of the Estate and Effects comprised in the foregoing Inventory are no nor any of them voluntary debts made payable on the death of the deceased or voluntary debts payable under some Instrument delivered to the decree thereof within three months before the death of the deceased or debt which are primarily payable out of any real estate belonging to the deceased, or debts in repeat whereof a reimbursement is capable of being reclaimed from any real estate of the deceased or from any other Estate or person whatsoever; that these debts with the funeral expenses of the said deceased as also shown in the said Schedule amount to seventy three pounds two shillings. That the nett value at this date of the said personal Estate and Effects situated in Scotland including the proceeds accrued thereon down to this date and after deducting?

? deducting the amount of said debts and funeral expenses are three hundred and fifty pounds Sterling and does not exceed four hundred pounds Sterling. That confirmation of the said Personal Estate is required in favour of the deponent and the said CATHERINE ANDERSON or SILVER: All which is truth as the deponent shall answer to God.

Follows Last Will and Testament before referred to: I ADAM SILVER farmer, residing at MILL OF MONQUICH in the Parish of Fetteresso being resolved to settle any affairs as to prevent dispute thereafter my death, do hereby nominate and constitute and appoint my spouse MRS CATHERINE ANDERSON or SILVER, PETER HOWIE grocer in Aberdeen and the survivors or survivor, acceptors or acceptor of them to be my Executors or Executor, Intromitters and Intromitter with my whole Estate that may pertain and belong or be resting owing to me at the time of my death with the whole vouchers and instructions of the same with power to give up Inventories thereof and to confirm the same and generally with all the powers competent to Executors: And I ordain my Executors to ordain my said spouse to take the sole management of my Estate including the Lease of the said Farm occupied by me if she shall survive me along with any two sons WILLIAM SILVER and ANDREW SILVER for my spouses own use and behoof as long as she shall survive, she being bound to pay all my just and lawful debts, sickbed and funeral expenses and after the death of my said spouse?

? spouse, I ordain my Executors or Executor and their foresaids to convert the whole of my Estate into money and pay and divide the same equally among my children namely WILLIAM, ANDREW, HELEN and CATHERINE and providing hereby that in the event of any of my children above named dying before my said spouse leaving lawful issue, such issue shall succeed to the share or shares which would have fallen to their deceased parent or parents had they survived such issues if more than one succeeding equally among them to such share or shares.
