Aldridge wins claim-jumping case
MINING
The practice of mining without miners' rights, which is said to be rather common at present, has lately been dealt with in a fashion which shows that the authorities intend to put a stop to it.
In a case - Aldridge v Chin Chin, of Nos. 6 and 7 south Smithfield - heard on Thursday, it appeared that the plaintiff had jumped two shares on the ground that the man representing T.Oswin had no miners' right; he had been put on by Chin Chin, who was aware of the illegality.
The verdict was for plaintiff, with costs, Mr Stable appearing for him; Oswin was fined ?5, the alternative of non-payment being 14 days imprisonment.
A witness named Cox admitted that he had been working without a miners' right, but pleaded as an excuse that he had only just come on to the field, and had not been engaged in any mining work; for this reason the penalty was not enforced, but he had had a narrow escape.
