That the deponent is an exector, nominated and appointed along with Mrs Mary Ann Falconer or Silver residing at Hillhead, Blairs, aforesaid his spouse and William Falconer, farmer, Newtonleys, Stonehaven, and John Silver, farmer, Harvieston, Kinneff, Stonehaven, in the mutual settlement executed by deceased and the said Mrs Mary Ann Falconer or Silver his spouse of date the 20th day of November 1897 which is herewith produced and signed by the deponent and the said George Kemp as relative hereto. That the deponent has entered, or is about to enter, upon the possession and management of the deceased's estate as executor foresaid, along with the said Mrs Mary Ann Falconer or Silver, William Falconer and John Silver. That the deponent does not know of any testamentary settlement or writing relative to the disposal of the deceased's personal or moveable estate or effects, or any part thereof other than the before mentioned mutual settlement. That the foregoing inventory, signed by the deponent and the said George Kemp is a full and complete inventory of the personal or moveable estate and effects of the said deceased, wheresoever situated, and belonging or due to him beneficially at the time of his death, in so far as the same has come to the deponent's knowledge. That the amount of estate duty (and interest thereon) payable upon this inventory as particularly shewn in the statemnet for estate duty and summary annexed hereto, is paid to the commissioners of inland revenue conform to the receipt upon page No. 1 hereof. That confirmation of the personal or moveable estate in Scotland amounting in value to 1110 pounds five shillings and threepence is now required.     Follows mutual settlement before referred to: We Jmes Silver, farmer, Blairs, Maryculter in the County of Kincardine and Mrs May Ann Falconer or Silver, spouses, being desirous to settle our affairs in the event of the death of either of us do hereby assign and dispone to and in favor of the survivor of us and of William Falconer, farmer, Newtonleys, Stonehaven, John Silver, farmer, Harvieston, Kinneff, Stonehaven and James Duguid, advocate in Aberdeen and the survivors or survivor, acceptors and acceptor of them and to ther assignees whomsoever all and sundry lands and heritable estate presently belonging to us and wheresoever situated as also all and sundry our moveable estate of every kind and description and wheresoever situated together with the writs and title deeds of the said heritable subjects and the vouchers and instructions of our moveable estate and we nominate and appoint our said trustees to be our sole executors. But declaring that the said general disposition is granted by us in trust always and for the uses and purposes aftermentioned namely: First. For payment of our just and lawful debts, deathbed and funeral expenses including the erection of a suitable tombstone and the expense of carrying these presents into execution. Second. That our said trustees shall hold the whole estate belonging to us or either of us and shall invest the same in their own names and pay over the interest or produce arising there: from the survivor of us during all the days of the life os such survivor and on the death of the survivor of us we direct thatour said trustees shall divide our whole estate equally share and share alike amonst our children Isabella Silver or Robertson, Jessie Menzie Silver or Kamester, James Silver and Alexander Silver providing that in the event of any of the said children predeceasing and leaving lawful issue such issue shall take their parent's share; and we give to our trustees powers of sale and that either by public roup or private bargain and also power to appoint a factor or agent to manage the trust who may be one of their own number and to allow such factor or agent the usual remuneration. And in general we give to our trustees and executors the fullest powers and immunities competent. and we reserve power of redemption. And we reserve full power to alter or revoke these presents in whole or in part.And we consent to the registration hereof nd of any codicils or additions hereto for preservation. In witness whereof these presents are subscribed by su at Blairs Maryculter on the twentieth day of November Eighteen hundred and ninety seven before witnesses Goerge Watt coachman and Christina Watt wife of the said George Watt both at Auchlunies Maryculter foresaid, the word "Kamester" on the twenty third line hereof being written partly on erasure before subscription.
